According to the Department of Infrastructure (DfI), the constructed entrance to the new park, which features home bargains, is different to what was on the original plans.
As such, DfI have informed the local planning authority, Fermanagh and Omagh District Council, which has now launched has an “enforcement case” under investigation.
A DfI spokesman said: “Access to the site was assessed for compliance with road safety standards during the planning application stage.
“The Department has recently responded to a planning application for discharge of conditions to advise the local planning authority that the constructed access layout did not comply with the agreed planning permission.”
A spokeswoman from the Council said: “The Council has an enforcement case under investigation in relation to the site and therefore it would be inappropriate to comment further at this time.
“The potential impact upon the local road network, surrounding houses and pedestrians from traffic generated by the new development, was an important material consideration when the Council approved the planning application for this development.”
A local resident said that they raised the issue with the Council after having their own planning application denied for road safety issues.
“It appears that there is one set of rules for big business and another set of rules for everyone else,” the resident said.
“The entrance has been constructed in a different manner to what is on the plans, and it is a safety issue as there isn’t enough space for two large vehicles to drive past each other.
“It should have been built to the letter of the application – why do everyday folk have rules to follow, but it doesn’t seem to apply to others?”
